# Terms of Use

These terms constitute an agreement between the service operator and anyone using the website https://yoseno.com. By creating an account or continuing to use the service, you accept these terms.

## What the service does

The service is provided by the operator — Yoseno (hereinafter, the operator) — and helps organizations run diagnostics: launch surveys, collect responses, analyze open-ended text, find growth points, assign owners, prepare recommendations, and verify changes in subsequent measurements.

The service is not legal, HR, or management advice. It provides material for making decisions, but the decision itself, priorities, and responsibility remain with the people and the organization.

## Accounts, organizations, and roles

The user is responsible for the accuracy of account information, the security of access, and actions taken under their account. The organization is responsible for assigning roles, keeping the team up to date, and ensuring access permissions are correct.

The organization administrator manages participants, teams, invitations, survey settings, access to results, and requests for exporting or deleting data within the available features of the service.

## Surveys and respondents

The organization is responsible for the lawfulness of launching the survey, the composition of the audience, the content of invitations, and providing respondents with a clear explanation of why responses are collected and who will see the results.

Anonymity and visibility modes must be selected before the survey is launched. The service must not be used for covert surveillance of employees, pressuring respondents, or collecting data that is not needed for the stated diagnostics.

## AI analysis and recommendations

AI is used as an assistant: it structures open-ended responses, prepares summaries, topics, and recommendation options. AI results must be reviewed by a human before any management action is taken.

The operator does not guarantee that a recommendation will automatically solve a problem or replace professional judgment. The responsible user evaluates the context, risks, and consequences of the decision.

## Data and privacy

The processing of personal data is described in the privacy policy, and the use of cookies is described in the cookie policy. The approach to anonymity, the visibility matrix, and data storage is described in the Trust Center.

The user must not upload to the service any data that is not needed for diagnostics, that is prohibited from being transferred, or that requires separate coordination with the organization, the respondent, or a regulator.

## Acceptable use

The service may not be used for illegal actions, spam, bypassing access restrictions, attempting to obtain others' data, interfering with the operation of infrastructure, uploading malicious code, or intentionally violating respondent anonymity.

If a violation creates a risk to the service, data, or other users, access may be restricted or suspended for the duration of the investigation.

## Pricing and payment

Pricing, limits, the AI analysis balance, and the terms of the corporate agreement are described on the pricing page or in a separate agreement with the organization.

The product is supplied and supported by Yoseno (hereinafter, the supplier). Orders and payments are processed through Paddle.com: Paddle acts as an authorized reseller and Merchant of Record, meaning it acts as the seller for the buyer, accepts payment, issues payment documents, and handles payment inquiries, including refunds. Payment details are processed by Paddle and are not stored by the supplier.

These roles are distinct: contact the supplier with questions about how the product works, access, features, and data, and contact Paddle with questions about payment, invoices, taxes, payment methods, and refunds. Prices are shown with or without taxes depending on the buyer's jurisdiction—this is reflected on the pricing page and in Paddle's payment documents.

## Credits

A credit is a unit of prepaid platform work: analysis of responses, preparation of summaries and recommendations. A credit is not money, an electronic means of payment, or any other monetary claim against the supplier.

It follows that a credit:

- cannot be withdrawn or paid out in money;
- cannot be exchanged for money and has no exchange rate of its own;
- cannot be transferred to another organization or otherwise disposed of.

The credit balance belongs to the organization to whose billing account the credits were accrued, and is spent on platform work within that organization. A credit is debited when the platform performs the work. The rules for payment refunds and what happens to the credit balance after an approved refund are described in the refund policy.

## Availability and changes to the service

The service is constantly evolving: features, the interface, templates, limits, and integrations may change. Significant client-visible changes are published in the changelog or communicated through work channels.

The operator strives for continuous availability of the service but does not guarantee the absence of interruptions caused by scheduled maintenance, incidents, or circumstances beyond the operator's reasonable control. Scheduled maintenance and operational status are described in the Trust Center or on the status page, when enabled.

## Content and methodology rights

Organization data, respondent answers, and uploaded materials remain the data of the organization or the respective rights holders. The organization grants the operator the right to process them to the extent necessary to provide the service.

The interface, methodological templates, design, texts, product logic, and software code belong to the operator or its rights holders, unless otherwise provided in the contract. Copying and using these materials outside the service without the operator's permission is not allowed.

## Warranties and liability

The service is provided "as is" to the extent permitted by applicable law. The operator provides diagnostic and analytical tools but does not control the organization's management decisions, internal communications, respondent composition, or user actions after they receive the results—and is not responsible for them.

Unless applicable law provides otherwise, the operator's aggregate liability for claims related to the service is limited to the amount actually paid by the organization for the period in which the basis for the claim arose. Claims are sent to the operator at the contact details given in the legal information and are reviewed within a reasonable time before court proceedings are initiated.

## Suspension and termination of access

A user may stop using the service and delete their account at any time from the /account page. The organization may stop using the service as set out in its plan or agreement. Before closing the organization's workspace, an administrator can request export or deletion of the organization's data in a supported format.

The operator may limit or suspend access in the event of a breach of these terms, a security threat, non-payment, or a requirement of applicable law, with notice to the account contacts where such notice is permitted and feasible. Once the cause is resolved, access is restored.

## Governing law and disputes

These terms are governed by the law of the country where the operator is registered, unless mandatory provisions of the user's country law provide otherwise. The parties first attempt to settle disputes through negotiation; if this fails, the dispute is referred to the competent court in accordance with applicable law.

## Changes to terms

The operator may update these terms. The current version is always published at https://yoseno.com/terms; material changes are additionally communicated through the service or via account contacts. Continued use of the service after a new version is published means acceptance of it.
